CopyrightsCopyrights protect the expression of an idea from being copied without authority. It does not protect the concept or idea. The first owner of a copyright work is its creator. An author in case of literary work is the person who wrote the work. This is also true for software, which is treated as a literary work.Copyright protection lasts for the life of the author plus 50 years after demise of the author.
TrademarksA trademark is a distinctive sign, which identifies goods or services as those produced or provided by a specific person or enterprise. The system helps consumers identify and purchase a product or service because its nature and quality, indicated by its unique trademark, meets their needs. A trademark provides protection to the owner of the mark by ensuring the exclusive right to use it to identify goods or services, or authorize another to use it in return for payment. Trademarks promote initiative and enterprise by rewarding the owners with recognition and financial profit. Trademark protection also hinders the effects of unfair competitors, such as counterfeiting. In Kenya, trademarks are protected under the Trademarks Act Cap 506.
